Our terms and conditions

By confirming your order you accept the following terms and conditions:

1. We are bkfancydress and these terms we refer to ourselves as bkfancydress.

2.  Any email or acknowledgement by us of a receipt of an order placed by you does not mean that we have accepted your order. Acceptance of your order and completion of the contract between you and bkfancydress will take place on dispatch to you of the products you’ve ordered, unless we have told you that we do not accept your order or you have cancelled it.

3. Your rights to cancel

You have the right to cancel an order but we may not be able to stop it being dispatched to you.  If you receive your order after you have cancelled it this means we were unable to stop it being dispatched and you must therefore return the goods in accordance with our Returns policy below.

You must cancel your order by email (a verbal phone cancellation is not accepted) as early in the day as possible. However, we may not be able to read your email before your order has been processed. Please note we usually process orders from 9.00am during normal working days (Monday to Friday) and your communication may reach us after we have processed your order.

All instructions to cancel must be clear and quote the acknowledgement number on the email you have received at the time you placed your order.

4.  Returns policy

All unused, unworn and unwashed merchandise purchased from the bkfancydress website may be returned for a refund within 7 days from receipt of merchandise (postage costs for returns are borne by you). We sell our costumes in re-sealable packing so that you can check their suitability. All items must be returned in their original condition with the original packaging.

We won’t refund:
• items that have been used, worn, washed or soiled
• items such as teeth, eyelashes, tights and wigs that have been opened. They must be returned unopened and unused with tamper seals in place when these are provided. This is for hygiene reasons.
• some costumes include sealed wigs. If the costume isn’t appropriate please don’t open the wig as, once opened, refunds can’t be given.

How to return items

Before sending the items back to us, you’ll need to ring us for a ‘returns number’. Call us on 020 8579 9135 between 9.30 and 4.30pm Monday to Friday or email on bkfancydress@hotmail.co.uk  so we can arrange for the return. You’ll need your order number, name and address so please have these when you call or include them in your email. We will give you a ‘returns number’ and when you return the item to us you’ll need to include the ‘returns number’. If this isn’t included it could delay your refund.
Items purchased on the website must be returned by post. We do not accept returns ordered on the website in the shop.

Include the delivery note or a copy of your email invoice with the goods. Send the goods in appropriate packaging.

We do not refund return despatch costs. It is your responsibility to return items to us; we recommend recorded delivery or Royal Mail special delivery as bkfancydress cannot be held responsible for loss or damage to goods whilst they are being returned.

Refunds will be made to the card that was used in the original purchase (or a cheque made payable to the cardholder if the card is no longer valid). You must follow our instructions for returning goods as explained above.

None of the above affects your statutory rights.

5. We may dispatch your order in a number of installments and each dispatch is a separate contract and is not connected to any other dispatch.

6. We will validate your credit or debit card before accepting your order. We will not accept your order if your card is declined at any stage during the processing of your order. We will try to contact you if your card is declined after you have placed your order but we may not be able to do this.

We take reasonable care to protect the confidentiality of your payment card details but bkfancydress is not liable if these details are intercepted by and used by third parties through no fault of our own.

7. The price shown against each item on the website includes VAT where applicable but does not include postage and packing charges. These are extra and shown in ‘Postage & delivery’.

8. The prices on our website may change from time to time. The current price shown on the website is the price you will be charged. Any variation to the price shown must be confirmed in writing by bkfancydress before your order is accepted by us.

9. We try to make sure that the prices and all other information on the website are accurate. However, we are not liable for anything that happens due to errors that may appear to the fullest extent permitted by law. Nothing in these ‘Terms and conditions’ is intended to limit any rights you might have as a consumer or other statutory rights that may not be excluded or in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

10. All the products on the website are subject to availability. Display of an item on the website is not an indication that the item is in stock. We do not guarantee that all items shown on the website are in stock and are available for dispatch.

11. If you have chosen an item that is not in stock we will try to contact you as quickly as we can. We will try to do this within 24 hours (except on weekends and public holidays when we don’t usually work). Please note that at busy times of the year including prior to Halloween, Christmas and New Year we cannot guarantee to contact you within this time.

13. The time for delivery of your order varies according to the method of shipment you’ve chosen. bkfancydress has no control over the goods once they are dispatched and cannot guarantee that your order will arrive within the time specified by your chosen method of dispatch.

14. We will not refund any charges relating to packing and dispatch if you fail to take delivery of the goods at the address given by you on your order.

15. Every effort is made to reproduce colours on our website as accurately as possible. However, different computers reproduce colours in slightly different ways and so exact colour matches are not possible over the internet. Because of the type of products we offer, there can be slight variations in colour and style from the descriptions and pictures on the website. We will always dispatch goods of comparable or superior quality.

16. If the costume you’ve chosen is not available for whatever reason and it is clear that the accessories relate to it, we will not dispatch the accessory items you may have included in your order.
 
17. This contract is deemed to have been made in England and is governed by English Law and the parties agree to submit to the exclusive jurisdiction of the English courts as regards any claim, dispute or matter arising out of or relating to this contract.
